Background

The UN agencies operating in Central South Somalia, Puntland and Somaliland have agreed with the local authorities on the need to organize a forum in each of the regions intended to establish a meaningful dialogue with the respective Government officials and UN personnel. While this exercise will be undertaken in Mogadishu and Garowe for the first time, the forum in Hargeisa will serve as a refresher workshop of the 2011 Privileges and Immunities forum, “Waan Wada Hadli Karnaa: We can talk together”. All three forums will discuss laws and policies and the framework of international law and standards for UN operations to help to improve operational efficiency on the ground and to strengthen the mutual understanding of the interests, rights and responsibilities of the governments and UN. The forums aim at improving communication channels between the officials of the three governments and UN agencies in order to have a better understanding of each other’s policies and practices. The forums should also help to identify mechanisms for resolution of future issues to improve effectiveness, efficiency and partnership in the future.

Duties and Responsibilities

In recent months, the governments of Central South Somalia, Puntland and Somaliland have requested clarification on a number of issues related to UN privileges and immunities and related responsibilities of the UN and its staff, including tax exemptions (goods and personnel), premises property and documents, as well as information disclosure, contract information and neutrality and independence in procurement processes. To address these issues together, the Somalia Operations Management Team (SOMT) proposes the workshop involve:

Relevant Ministries, Local Authorities and Commissions
UN Agencies
Legal Experts from UN agencies and programmes
The respective universities, namely the Mogadishu University, the Puntland State University and the University of Hargeisa, Law faculty personnel

Expected Outputs and Deliverables


The Consultant is expected to:

Design the Privileges and Immunities Forums for the three locations, including appropriate meeting schedules, and adapt it to their specific requests as for instance detailed in the issue matrixes.
Agree the agenda with the three governments and with the UN legal experts (keeping in mind that the forums in Mogadishu and Garowe need to cover the entire legal UN framework regarding privileges and immunities and related responsibilities, including taxation and UN imports, as well as procurement principles, regulations on information disclosure and UN premises, while the forum in Hargeisa is a refresher course, building on the 2011 Privileges and Immunities Forum.
Based on the recommendations of the TAM include a dialogue about appropriate agreements with UN entities and the Somali Federal Government in the context of the Mogadishu forum.
Identify the government counterparts and invite them to the forums, following up to ensure the participants come to the meetings.
Liaise with the respective Universities (with UNDP’s help) to find appropriate in-country capacity to facilitate the Forums and provide a repository of information.
Support the compilation of documentation for the three forums.
Design the take-away material that will be provided to participants and to their respective ministries.
Provide on-site support to the three Forums in late May, including identifying and booking of venues, arranging refreshments and food, distributing relevant documents, and arranging for translation.
If possible given the time constraints, arrange a side event with a wider group of UN staff on their privileges and immunities, as well as including responsibilities.
Detailed report on outcomes of all three forums, including the compilation of a follow-up action matrix for each location.
Advise on next steps, including in the event that discrepancies between Somali law and international law are noted.

Institutional Arrangements

Preparatory mission to Mogadishu and the round-trip to Mogadishu, Garowe and Hargeisa.
UN Agencies will contribute HQ legal experts, procurement officers and operations managers to contribute to the workshop session and document preparation. UNDP field offices will assist in liaising with appropriate partners and counterparts, such as government authorities and personnel of the Law faculties.

36 days, including:
4 days of preparation in the run up to the mission
4 days per location of preparatory mission
14 days of workshop
6 days of follow-up (2 days per location)

Communication: The suitable candidate will have excellent written and oral communication skills in English and Somali. He/ She will demonstrate superior writing skills – clear, persuasive and experienced enough to prepare comprehensive guidelines.
Teamwork: Ability to establish and maintain good working relations with colleagues, external partners and government authorities in a multi-cultural environment, and effectively coordinate programme activities including different stakeholders.

Required Skills and Experience
Education:
An advanced degree (Masters) in Law, Public Administration, International Relations, Political Science, or a related field.

Experience:
5 years or more of related professional experience.
Previous experience in working with the Somali authorities, preferably with the governments of all three regions, is desirable.
Knowledge of the UN system and the UN privileges and immunities is desirable.

Language requirements:
Excellent written and communication skills in English and Somali
Other Information

The expert will be required to have a personal lap top computer.
Travel and Visa/Terminals will be borne by UNDP Somalia.

Terms of Service
This is a non-staff contract under the Individual Contractor (IC) modality of hiring of the UNDP. Individuals engaged under an IC serve in their individual capacity and not as representative of a government institutions, corporate body or other authority external to UNDP. The incumbent shall not be considered as staff of UNDP, the UN common system or the government and are therefore not entitled to any diplomatic privileges or any other special status or conditions.
